Choosing the Right Marital Assets During Divorce

In this narrative, we share a success story that exemplifies our commitment to assisting clients in achieving a fulfilling present while planning for a prosperous future.

The Clients

A couple in the process of divorce finds themselves navigating the division of their marital assets. While the husband has been primarily responsible for managing the couple's investment portfolio, the wife has limited knowledge of their financial affairs. Now, with guidance from their respective attorneys, they are considering how to distribute their assets.

The husband discloses that the investment portfolio consists of R2 million in real estate and R2 million in publicly traded stocks. The simplest solution would be for one spouse to take ownership of the real estate while the other claims the stocks. In this scenario, we explore two possible scenarios to determine which investments would be most suitable for the wife.

Challenge

How to make wise financial choices about marital assets during divorce.

Scenario 1

In this scenario, the couple decides that the wife will take ownership of the real estate as it is perceived as a stable investment compared to the volatile stock market. However, unforeseen challenges arise for the wife after the settlement. She discovers that managing the properties comes with financial obligations, including regular payments that strain her budget. As she struggles to cover her expenses, the illiquidity of real estate becomes apparent, making it difficult for her to sell the properties at a favorable price. Unfortunately, some properties are sold at a discount, and the remaining properties face repossession.

Two years later, the husband's stock positions have flourished, reaching a value of R2.3 million. While the wife's liquidity crisis has improved, she is left with only R1 million after liquidating her properties. In contrast, the husband's savvy investment decisions have made him R1.3 million wealthier. This outcome highlights the importance of carefully considering the liquidity and ongoing financial commitments associated with different assets during divorce proceedings.

Scenario 2

In this scenario, the couple agrees that the wife will take ownership of the stock positions, considering their liquidity and lower management requirements. However, an oversight occurs during the negotiation process. The husband had acquired the real estate properties at discounted prices from distressed sellers, which were not reflected in the presented valuations. Unfortunately, the wife and her attorney were unaware of this crucial information.

At the same time, the stock market experiences a challenging period, causing the value of the wife's stock positions to decline from R2 million to R1.8 million. Two years after the settlement, the husband is sitting on real estate valued at R3 million, significantly exceeding its initial valuation. In contrast, the wife holds stock valued at R1.8 million, reflecting the decline in the stock market. As a result, the husband finds himself R1.2 million wealthier than the wife due to the undervalued real estate and the market downturn.

This scenario emphasises the significance of conducting thorough due diligence and seeking professional advice during divorce proceedings. It highlights the importance of understanding the true value of assets and considering potential market fluctuations to make informed decisions about marital assets.

Strategy and Solution

Now let's rewind and consider an alternate approach. Before making any decisions, the wife's attorney recommends consulting with SA Financial Planners. We conduct a comprehensive analysis of the portfolio's investments, carefully assessing their potential and aligning them with the wife's risk tolerance. Recognising the importance of diversification, our planners advise the wife to divide her assets by taking half of the stock portfolio and half of the real estate properties. SA Financial Planners then diligently allocates the stock assets in accordance with her investment objectives, while entrusting the management of the properties to a top real estate expert.

Results

The wife's decision to hold equal shares of securities and real estate, guided by SA Financial Planners expertise, has provided her with the ability to navigate market fluctuations and capitalise on opportunities. With our dedicated management and strategic approach, she preserves the initial value of her assets while positioning them for potential future growth. This balanced allocation ensures that her portfolio remains resilient and responsive to changing market conditions, empowering her to make the most of her investments.
